TERMS OF SERVICE Effective Date: October 1, 2026 These Terms of Service govern diagnostic, mobile mechanic, repair, towing, programming, electrical, maintenance, parts installation, and related vehicle services provided by Mobile Mechanic (“Company,” “we,” “us,” or “our”). By requesting service, authorizing service, scheduling an appointment, accepting an estimate, providing payment information, making a deposit, or allowing a technician to begin service, the customer acknowledges and agrees to these Terms. 1. Mobile Service We provide mobile vehicle services at customer locations and other approved service locations. Service depends on: Technician availability Customer location Vehicle condition Weather Safety Parts availability Equipment requirements Access to the vehicle Type of service requested Requested appointment times are not guaranteed until accepted. 2. Customer Information Customers must provide accurate information including: Name Telephone number Complete service address Vehicle year Make Model Engine or fuel type when known Description of the problem Requested service Whether the vehicle starts or runs Customers should disclose known modifications, previous repairs, or conditions that may affect diagnosis or repair. 3. Vehicle Access The customer must provide reasonable and safe access to the vehicle, including when necessary: Vehicle keys Wheel-lock key Access to the vehicle Permission to operate vehicle systems Permission to perform testing Adequate and safe working space Incorrect addresses, inaccessible vehicles, missing keys, unsafe work locations, or conditions that prevent service may result in additional charges. 4. Standard Diagnostic Fee — $125 The standard mobile diagnostic fee is: $125 This applies to standard service locations that are not designated as Cross-Tunnel Service Areas. The diagnostic charge compensates for: Technician travel Technician time Mobile service dispatch Professional diagnostic equipment Scan tools Testing equipment Vehicle testing Diagnostic procedures Technician knowledge Service vehicle operating expenses The diagnostic charge also functions as a mobile equipment and technician mobility fee. The diagnostic charge becomes due once the technician has been dispatched or diagnostic service has begun. 5. Cross-Tunnel Diagnostic Fee — $220 Locations requiring travel across the tunnel or otherwise designated as Cross-Tunnel Service Areas are subject to a: $220 diagnostic and mobile equipment fee. The $220 fee accounts for additional: Travel Tunnel transportation Technician time Fuel Service vehicle expenses Equipment transportation Scheduling requirements The Cross-Tunnel Diagnostic Fee remains $220 and is not replaced by the standard $125 diagnostic rate. 6. Diagnostic Fee When Repairs Are Declined Diagnostic fees remain due when diagnostic service has been performed, even when the customer chooses not to proceed with recommended repairs. Declining a repair does not eliminate the diagnostic or mobility charge. Unless specifically stated otherwise in writing, diagnostic charges and repair charges are separate. 7. Payment of Diagnostic Charges Diagnostic and mobility charges are due upon completion of diagnostic service or when the customer declines further work. Leaving the location, refusing repair, failing to respond, or refusing payment does not cancel a properly authorized diagnostic charge. If payment is not received, an outstanding invoice may be electronically sent to: Customer telephone number Email address Electronic payment system Other contact information supplied by the customer The invoice remains due until paid or otherwise legally resolved. 8. Unpaid Invoices Failure to pay an authorized diagnostic, mobility, repair, towing, programming, labor, parts, or other service charge creates an outstanding balance. Authorized charges remain due even if payment is not made while the technician is physically present. Unpaid balances may be pursued through lawful collection procedures. Documentation used for collection may include: Customer information Phone number Service address Vehicle description VIN Invoice Estimate Service authorization Text messages Telephone records Photographs Video recordings Diagnostic results Repair documentation Payment records We reserve the right to pursue collection, civil remedies, and any lien rights or other legal remedies available under applicable Virginia law when applicable legal requirements are satisfied. Nothing in these Terms creates an automatic lien solely because a vehicle VIN appears on an invoice. 9. Vehicle Lien Rights We reserve any legally available mechanic's lien, towing lien, storage lien, or other lien rights that may apply under Virginia law. Availability and enforcement of any lien depend on the circumstances and applicable legal requirements. The VIN may be used to identify a vehicle associated with an unpaid account or legally available collection action. 10. Advanced Diagnostic Time When diagnostic testing requires more than two hours, additional diagnostic time after the first two hours may be charged at: $125 per hour Additional time requires customer authorization when reasonably practical. Advanced diagnostic work may include: Electrical faults Intermittent problems CAN communication faults Wiring problems Programming problems Modified vehicles Multiple-module faults Mechanical testing Previous improper repairs Extensive circuit testing Component access or disassembly 11. Diagnostic Limitations Diagnostic service represents professional testing and evaluation based on vehicle conditions present at the time of inspection. A diagnostic does not guarantee that every current or future vehicle problem will be identified during one visit. Some problems may be: Intermittent Temperature dependent Load dependent Hidden Mechanical Electrical Software related Caused by multiple components Additional testing may be required. 12. Third-Party Diagnostics Information supplied by: Parts stores Other mechanics Repair shops Customers Previous scan reports Online sources Other third parties may be considered as background information. We are not required to replace a component solely because another party recommended replacement. Our own diagnostic process may be required. 13. Estimates and Authorization Estimates are based on information available when prepared. Additional problems may be discovered after: Testing Disassembly Removing parts Accessing wiring Inspecting hidden components Beginning repairs When additional work is required, work will be paused when reasonably practical until authorization is received. Customer authorization may be documented by: Text message Telephone Recorded telephone authorization Electronic estimate Invoice Electronic signature Payment Other documented communication 14. Parts and Deposits Jobs requiring parts may require a: 50% deposit before parts are ordered. The remaining balance is due when authorized work is completed unless another arrangement is approved. Special-order, programmed, VIN-specific, opened, installed, electronic, or otherwise non-returnable parts may not be refundable. Parts pricing may include legitimate costs associated with: Sourcing Ordering Transportation Pickup Delivery Handling 15. Customer-Supplied Parts Parts supplied by the customer carry no parts warranty from Mobile Mechanic. The customer assumes responsibility for: Part quality Correct fitment Compatibility Completeness Manufacturing defects Premature failure Incorrect parts Used parts Remanufactured parts Parts purchased from third parties Installation of a customer-supplied part does not constitute a warranty or endorsement of that part. When Mobile Mechanic installs a customer-supplied part, only the installation workmanship is eligible for warranty coverage. Customer-supplied parts receive a maximum 7-day workmanship warranty on the installation only. The 7-day period begins on the date installation is completed. This limited workmanship warranty does not cover: Failure of the part itself Defective parts Incorrect parts Incompatible parts Used-part failure Internal component failure Electrical failure originating inside the supplied component Manufacturing defects Damage caused by the supplied part Removal and replacement of a defective supplied part Additional diagnostic time caused by a defective supplied part If the supplied part is defective, incorrect, incompatible, or fails after installation, additional labor may be charged to remove, diagnose, or replace it. 16. Payment Methods Accepted payment methods may include: Cash Credit or debit card Zelle Electronic or card transactions may include applicable processing charges when properly disclosed. Full payment is due according to the approved invoice or service authorization. 17. Cancellation and Rescheduling Customers should provide at least 12 hours' notice when cancelling or rescheduling confirmed service. If a technician has already been dispatched or is traveling to the customer, a: $95 dispatch/cancellation charge may apply. Diagnostic or service charges become nonrefundable once the technician has been dispatched, arrived, or work has begun. 18. No-Show Technicians are not required to wait indefinitely. The standard customer waiting period is approximately: 15 minutes unless another arrangement has been made. If the customer: Does not appear Provides the wrong address Does not provide vehicle access Does not provide keys Cannot be contacted Otherwise prevents service a $95 no-show/service-call charge may apply. 19. Service Hours and Rush Service Standard operating hours are generally: 9:00 AM – 5:00 PM After-hours, emergency, urgent, weekend, and rush service are subject to availability and additional charges. Approved overnight/rush service between approximately: 7:00 PM – 5:00 AM may be charged at: $250 per hour plus applicable taxes unless another rate is approved before service begins. Rush service does not guarantee an exact arrival or completion time. 20. Towing Services Towing customers must provide accurate: Vehicle information Pickup location Destination Towing prices may depend on: Distance Vehicle size Vehicle weight Accessibility Vehicle condition Loading requirements Tolls Recovery conditions Special equipment Winching Whether the vehicle rolls, steers, brakes, or shifts into neutral Additional charges may apply when unusual recovery or loading procedures are required. 21. Workmanship Warranty on Company-Supplied Repairs Unless a different warranty is specifically stated in writing, eligible repair labor where parts are supplied through Mobile Mechanic carries a: 30-day workmanship warranty from the date service is completed. This warranty applies only to the workmanship actually performed. The customer must provide Mobile Mechanic a reasonable opportunity to inspect and perform the first correction of a claimed workmanship issue. If another mechanic, repair shop, technician, or third party modifies, removes, adjusts, repairs, or disturbs the affected area before our inspection, applicable workmanship coverage may be voided. 22. Parts Warranty on Company-Supplied Parts Parts supplied through Mobile Mechanic may carry manufacturer or supplier warranty coverage, generally up to: 90 days when applicable subject to the actual supplier or manufacturer warranty. Parts warranty does not automatically include labor. Any labor required to replace a defective warranted part is covered only when specifically stated. 23. Customer-Supplied Parts Warranty Summary For clarity: Customer supplies the part: No warranty on the part 7-day workmanship warranty on installation only Mobile Mechanic supplies the part: Eligible labor may receive 30-day workmanship coverage The part may carry supplier/manufacturer warranty when applicable 24. Warranty Exclusions Warranty does not cover problems resulting from: Normal wear Abuse Misuse Accident damage Overheating Lack of maintenance Continued operation after a warning Incorrect fluids Contamination Racing Off-road use Unrelated failures Pre-existing conditions Vehicle modifications Customer-supplied defective parts Third-party work New failures occurring after service 25. Pre-Existing Conditions Vehicles may contain pre-existing conditions including: Rust Corrosion Seized hardware Broken fasteners Previously damaged components Damaged connectors Improper repairs Modified wiring Deteriorated plastics Brittle hoses Internal damage Discovery of a condition during service does not automatically establish that the technician caused that condition. Additional work caused by hidden or pre-existing conditions may require additional authorization. 26. Broken or Seized Hardware Removal of: Rusted bolts Seized bolts Broken bolts Stripped bolts Cross-threaded hardware Rounded hardware Broken studs Damaged nuts Damaged screws involves additional risk. Successful removal without additional damage cannot be guaranteed. Additional labor, extraction, drilling, machining, hardware replacement, or component replacement may be required. 27. Programming and Electronic Modules Programming, coding, relearning, immobilizer work, electronic module replacement, and related electrical services depend on vehicle condition and system compatibility. Successful programming cannot be guaranteed when components are: Defective Damaged Incorrect Incompatible Previously modified Locked Unsupported Additional diagnostic or programming charges may apply. 28. Photos, Video, and Service Recording Mobile Mechanic routinely photographs and/or video records vehicle service processes for documentation. The customer acknowledges and authorizes reasonable documentation of the vehicle and work being performed. Documentation may occur: Before service During diagnosis During disassembly During repair During testing After completion Documentation may include: VIN Mileage Vehicle condition Existing damage Warning lights Scan-tool results Diagnostic tests Components Parts Wiring Fluids Repairs Work procedures Completed work These records may be used for: Customer service records Warranty claims Insurance matters Chargebacks Payment disputes Collection matters Legal proceedings Protection of Mobile Mechanic and its technicians 29. Recorded Communications Telephone calls and other communications may be recorded when legally permitted. When required or appropriate, callers will be informed that the communication is being recorded. Electronic communications, including text messages, may be maintained as evidence of: Service requests Estimates Authorizations Customer instructions Payment obligations 30. Repair Results A repair addresses the condition diagnosed and authorized for repair. Repairing one condition does not guarantee that the vehicle has no other: Mechanical problems Electrical problems Electronic problems Software problems Intermittent faults Future failures Separate vehicle systems can fail independently. 31. Refund Policy Diagnostic and mobility fees are nonrefundable once the technician has been dispatched or diagnostic work has begun. Completed labor is nonrefundable except when correction is required under an applicable workmanship warranty. Installed, programmed, VIN-specific, special-order, electrical, used, or otherwise non-returnable parts generally cannot be refunded once installed or used. Completed towing, transportation, travel, dispatch, and service charges are nonrefundable. 32. Safety and Right to Refuse Service We may refuse, stop, postpone, or reschedule service when conditions create unreasonable risk. Examples include: Severe weather Unsafe traffic Insufficient workspace Dangerous property conditions Hazardous vehicle conditions Aggressive conduct Threatening behavior Unsafe customer requests 33. Virginia State Safety Inspections We do not provide Virginia State Safety Inspections unless specifically authorized and legally qualified to do so. A diagnostic inspection is not a Virginia State Safety Inspection. 34. Limitation of Responsibility To the extent permitted by law, Mobile Mechanic is not responsible for indirect or consequential losses arising from: Vehicle downtime Lost business Lost income Missed appointments Rental vehicle expenses Transportation expenses Loss of use Unrelated towing expenses Separate vehicle failures Nothing in these Terms limits responsibilities that applicable law does not permit a business to limit. 35. Governing Law These Terms are governed by applicable federal law and the laws of the Commonwealth of Virginia. 36. Changes to Terms These Terms, service policies, service areas, procedures, and pricing may be updated from time to time. The version in effect when service is authorized generally governs that transaction unless applicable law requires otherwise. 37. Entire Service Agreement These Terms, together with: Approved estimate Invoice Customer authorization Applicable warranty Documented communications constitute the service agreement relating to the authorized work.
